Background Regulations on research ethics in France have evolved considerably over the past four years: the implementation of the Jardé law and of the General Data Protection Regulations have changed the landscape of research ethics for research involving or not involving human persons. In a context of creation of an Institutional Review Board at the University of Bordeaux, France, we sought to explore research ethics practices and perceptions in the medical community of our University Hospital. Methods A short questionnaire was (...) sent to all physicians of the University Hospital of Bordeaux. The questionnaire included closed questions and main topics were: physicians’ education in research ethics, ethics practices concerning researches non implying human persons, and physicians’ perceptions about current regulations. Results 86 questionnaires were sent back. If a majority of physicians have validated Good Clinical Practices trainings, there was a low rate of specific training on fundamental references in research ethics and a high proportion of responders do not consider themselves as educated in research ethics after completion of GCPs. Regulations on research ethics have many implications on medical research, especially by inducing changes in protocols in order to alleviate ethical requirements. Malpractices were acknowledged like false mention of positive opinion from an ethics committee. If If a majority of responders considers regulations as a positive answer to research ethics, a large majority considers it as a constraint and a complexification of research process. For 58%, regulations in research ethics are perceived as a hindrance for research initiatives. Conclusion Because of their impact on research process, regulations seem to constitute a scarecrow for physicians. Lack of training, bad representations and questionable practices highlight the need to improve education and to propose concrete guidance for medical researchers. (shrink)

This paper describes the Electronic Schoolbag, a digital workspace developed at the University of Savoie (France) and analyses its usages. This online environment is dedicated to the educational world: it offers pupils, students, teachers, school staff, or parents, personal and group workspaces in which individual or collaborative activities can take place. The flexibility of this software, allowing synchronous or asynchronous activities, lies in the “participation model”. This model allows groups themselves to describe and organise their activities. The architecture that permits (...) its implementation in the Electronic Schoolbag workspace is described. The study of the practices of the workspace is then presented. This requires different observation methods, according to the different procedures chosen: real practices provided by quantitative methods (analysis of the logs of the actions and questionnaires) and imagined practices provided by qualitative methods (semi-directive interviews). The results obtained from the university users allow us to assess the evolution of the usages for different periods and on different university sites. The observatory also lets us list the main uses of the Electronic Schoolbag for educative communication (collaborative vs. individual, informative vs. communicative). (shrink)

Background and objective: Assuming the hypothesis that the general practitioner can and should be a key player in making end-of-life decisions for hospitalised patients, perceptions of GPs’ role assigned to them by hospital doctors in making withdrawal decisions for such patients were surveyed.Design: Questionnaire survey.Setting: Urban and rural areas.Participants: GPs.Results: The response rate was 32.2% , and it was observed that 70.8% of respondents believed that their participation in withdrawal decisions for their hospitalised patients was essential, whereas 42.1% believed that (...) the hospital doctors were sufficiently skilled to make withdrawal decisions without input from the GPs. Most respondents were found to believe that they had the necessary skills and enough time to participate in withdrawal decisions. The last case of treatment withdrawal in hospital for one of their patients was described by 40% of respondents, of whom only 40.0% believed that they had participated actively in the decision process. The major factors in the multivariate analysis were the GP’s strong belief that his or her participation was essential , information on admission of the patient given to the GP by the hospital department , rural practice , visit to the patient dying in hospital and a request by the family to be kept informed about the patient .Conclusion: Strong interest was evinced among GPs regarding end-of-life issues, as well as considerable experience of patients dying at home. As GPs are more closely corrected to patients’ families, they may be a good choice for third-party intervention in making end-of-life decisions for hospitalised patients. (shrink)

Despite the importance of extrapair copulation (EPC) in human evolution, almost nothing is known about the design features of EPC detection mechanisms. We tested for sex differences in EPC inference-making mechanisms in a sample of 203 young couples. Men made more accurate inferences (φmen = 0.66, φwomen = 0.46), and the ratio of positive errors to negative errors was higher for men than for women (1.22 vs. 0.18). Since some may have been reluctant to admit EPC behavior, we modeled how (...) underreporting could have influenced these results. These analyses indicated that it would take highly sex-differentiated levels of underreporting by subjects with trusting partners for there to be no real sex difference. Further analyses indicated that men may be less willing to harbor unresolved suspicions about their partners’ EPC behavior, which may explain the sex difference in accuracy. Finally, we estimated that women underreported their own EPC behavior (10%) more than men (0%). (shrink)

Kant, who followed Newton’s interest in the history of nature, made the idea of God a principle, not of knowledge of an object but of the control of research. He accepted to speak of a finality of creation in order to understand human freedom. The paradigm of creation comes from the idea of acting freely and imposes itself when there is a question of the future. The excess of the world where man lives provokes his admiration and gives him the presentment of transcendence .In our day, ecology’s concern with the environment brings back the problem of creation under the form of man living in his world. Biblical anthropocentrism means, in this context, that it is the job of man to make this world habitable for everyone, without violence and in beauty. Bullying is a serious problem in today’s workplace, in that, a large percentage of employees have either been bullied or knows someone who has. There are a variety of ethical concerns dealing with bullying—that is, courses of action to manage the bullying contain serious ethical/legal concerns. The inadequacies of legal protections for bullying in the U.S. workplace also compound the approaches available to deal ethically with bullying. While Schumann (2001, Human Resource Management Review 11, 93–111) does not explicitly examine bullying, (...) the five moral principles that he advocates can be applied to judge the ethics of bullying in the workplace. A possible limitation of this model is that, it is designed to be normative (judgmental), and while it does take into consideration the relationships among the victim, the perpetrator, the groups in the organization, and the organization itself in judging the ethics of bullying, it does not explicitly consider the process by which bullying might develop and persist. In order to gain a deeper understanding of the dynamics of this process, Nijhof and Rietdijk (1999, Journal of Business Ethics 20(1), 39–50)) suggest applying an A–B–C (antecedents, behaviors, and consequences) model to help understand the dynamics of bullying in the workplace. Formal propositions are offered to guide both academics and practitioners to an enriched understanding of the ethics of workplace bullying. (shrink)

Apesar disto, formam um conjunto coerente e articulado no qual se abordam os principais problemas pedagógicos com um olhar crítico e sustentado na realidade da America Latina e do Caribe. Este trabalho pretende esboçar uma sistematização dos principais problemas pedagógicos trabalhados pelo cubano com o propósito de (...) contribuir com um olhar crítico sobre o ensino de filosofia na nossa América. The approach is developed dialectically by the two interlocutors, a series of critical points are debated and an alternative view is introduced. The dialogical form is intended to honor the general philosophical approach of the author summarized in the last sentence of the book, where he states that he sees philosophy as an ongoing, open-ended dialogue.

Comment concilier le relatif et l’universel? C’est à cette délicate tâche que s’était attelée il y a déjà quelques années Madame Delmas-Marty, spécialement dans le domaine des droits de l’homme. Le présent ouvrage envisage une difficulté supplémentaire en croisant les interrogations sur le pluralisme juridique avec la question de l’effectivité du droit économique. La prise en compte des pluralismes, notamment du pluralisme juridique, contribue-t-elle à une meilleure effectivité du droit économique? Ou bien, au contraire, le pluralisme juridique est-il un (...) facteur d’ineffectivité du droit économique? Dans cette recherche, les auteurs se sont attachés au pluralisme aussi bien dans la production du droit économique que dans le règlement des différends. C’est ainsi que le lecteur est appelé à cheminer dans la diversité des formes nouvelles qu’empruntent les régulations juridiques pour partir à la recherche des multiples intérêts que peut prendre en charge le droit économique, qu’ils soient individuels, collectifs ou même futurs. Dans les sociétés démocratiques, le droit est le texte où s'écrivent nos croyances fondatrices : croyances en une signification de l'être humain, croyances dans la force des lois et l'empire de la justice, croyances dans les valeurs sociales de l'Interdit. Le droit impose donc un sens commun qui permet aux individus de se lier entre eux et de vivre ensemble, il fonctionne aussi comme une vérité du moment. Il se nourrit et accompagne les transformations sociales et culturelles qui touchent non (...) seulement les sociétés nationales, mais également l'espace mondialisé. Le droit enregistre, selon ses propres temporalités, les changements de valeurs, l'émergence de nouvelles inquiétudes, l'évolution des techniques et des connaissances. Depuis quelques années, nous assistons à une "demande" accrue de droit et de régulation juridique. Nous chercherons tout d'abord à repérer et identifier les nouveaux territoires du droit en montrant comment la norme juridique contribue en permanence à réinventer le réel, à fabriquer inlassablement la condition humaine, à se présenter sans cesse comme l'instituteur du social. Ce mouvement de juridicisation du social et du politique se traduit non seulement par une prolifération et une diversification de la règle de droit, mais également par un processus parallèle de judiciarisation qui voit un certain nombre de problèmes être traités par l'institution judiciaire (politiques de santé, de sécurité, phénomènes de criminalité internationale, etc.). In this paper, we present a theory of interaction between definiteness and quantifier structure, where the definite determiner (D) performs the function of contextually restricting the domain of quantificational determiners (Qs). Our motivating data come from Greek and Basque, where D appears to compose with the Q itself. Similar compositions are found in Hungarian and Bulgarian. Following earlier work (Giannakidou 2004, Etxeberria 2005, Etxeberria and Giannakidou 2009) we define a domain restricting function DDR, in which D modifies the Q and (...) supplies the contextual variable C to intersect with Q’s domain. DDR can also modify the NP in which case it works like an intersective modfier— and we suggest that this is the case in St’át’imcets Salish (drawing on data from Matthewson’s work). The result of DDR will be restricting the domain of Q by C, a weakly familiar property (in the sense of Roberts 2003, 2010), i.e. it is entailed in the common ground of the context. As a result of intersecting with this property, the Q that undergoes DDR becomes presuppositional, and we hypothesize that all presuppositional Qs (each-like Qs) have an underlying derivation of the domain restriction via D that we see in Greek and Basque overtly. Our analysis provides support for the program that domain restriction is grammatically represented, but we propose an important refinement: domain restriction can affect the Q itself (in agreement with von Fintel 1998, Martí 2003, Giannakidou 2004; pace Stanley 2002), and in fact quite systematically. We also show that the Q that is affected by DDR is a strong one, and explain the inability of weak Qs to undergo DDR as following from their status as adjectival. (shrink)

The tendency to reciprocate – to return good for good and evil for evil – is a potent force in human life, and the concept of reciprocity is closely connected to fundamental notions of ‘justice’, ‘obligation’ or ‘duty’, ‘gratitude’ and ‘equality’. In _Reciprocity_, first published in 1986,_ _Lawrence Becker presents a sustained argument about reciprocity, beginning with the strategy for developing a moral theory of the virtues. He considers the concept of reciprocity in detail, contending that it is a basic (...) virtue that provides the basis for parental authority, obligations to future generations, and obedience to law. Throughout the first two parts of the book, Becker intersperses short pieces of his own narrative fiction to enrich reflection on the philosophical arguments. Le jeune Heidegger, dont la lecture principale demeura pendant de longues années les Recherches logiques de Husserl, a consacré ses premiers travaux aux problèmes logiques. Sa Dissertation de 1914 analyse les théories du jugement de cinq logiciens contemporains, Wundt, Maier, Brentano, Marty et Lipps qui ont en commun de demeurer à l'intérieur du psychologisme, c'est-à-dire de considérer le jugement comme un acte psychique au lieu de le situer, comme le fait Husserl, dans la sphère logique du sens. C'est sur (...) cette notion de sens que le jeune Heidegger fait porter ses questions et c'est l'analyse de sa structure relationnelle qui lui permet, en s'appuyant sur la théorie de la validité de Lotze et à la suite de Lask et de sa Théorie du jugement de 1912, d'éclairer décisivement la nature proprement logique du jugement. The young Heidegger concentrates his questions on this notion of sense and through the analysis of its relational structure, with the help of Lotze's theory of validity and in following the indications given by Lask in his book of 1912 on The Theory of Judgment, he undertakes a decisive elucidation of the properly logical nature of judgment. Stephen Hawking, among others, has proposed that the topological stability of a property of space-time is a necessary condition for it to be physically significant. What counts as stable, however, depends crucially on the choice of topology. Some physicists have thus suggested that one should find a canonical topology, a single ‘right’ topology for every inquiry. While certain such choices might be initially motivated, some little-discussed examples of Robert Geroch and some propositions of my own show that the main candidates—and (...) each possible choice, to some extent—faces the horns of a no-go result. I suggest that instead of trying to decide what the ‘right’ topology is for all problems, one should let the details of particular types of problems guide the choice of an appropriate topology. What is nontrivial digital computation? It is the processing of discrete data through discrete state transitions in accordance with finite instructional information. The motivation for our account is that many previous attempts to answer this question are inadequate, and also that this account accords with the common intuition that digital computation is a type of information processing. We use the notion of reachability in a graph to defend this characterization in memory-based systems and underscore the importance of instructional information for (...) digital computation. We argue that our account evaluates positively against adequacy criteria for accounts of computation. (shrink)

In two recent papers, Michael Della Rocca accuses Descartes of reasoning circularly in the Fourth Meditation. This alleged new circle is distinct from, and more vicious than, the traditional Cartesian Circle arising in the Third Meditation. We explain Della Rocca’s reasons for this accusation, showing that his argument is invalid.

The Battle of Drepana in 249 b.c. marks the most significant defeat of Roman naval forces at the hands of their Carthaginian opponents during the First Punic War. Attempting to take the Punic fleet in the harbour of Drepana by surprise, the consul P. Claudius Pulcher sailed with his ships from Lilybaeum about midnight, and reached Drepana at dawn. Yet, owing to swift and level-headed counter-measures taken by the Punic commander, Adherbal, the unfolding fight – partly in the harbour, mostly (...) off the shore – turned into a fiasco for the Romans. This essay argues that retrieving insights from the ancient Stoic philosophers for Christian ethics is much more difficult than is often assumed and, further, that the "ethics of retrieval" is itself something worth prolonged reflection. The central problem is that in their ancient sense both Christianity and Stoicism are practically dense patterns of reasoning and mutually incompatible forms of life. Coming to see this clearly requires the realization that the encounter between Stoicism and Christianity is a conflict of lived traditions. (...) Precisely because we cannot simply extract Stoic insights from the lives in which they belong, the task of determining how Stoicism is useful for Christianity is exceptionally challenging. Indeed, doing justice to the Stoics has more to do with facing an alternative to Christianity than it does with appropriating insights for our own use. These points are developed in conversation with Elizabeth Agnew Cochran's recent article on the Stoic influence upon Jonathan Edwards. This essay is a response to C. Kavin Rowe's critique of my 2011 argument that certain dimensions of Roman Stoic ethics are at work in Jonathan Edwards's moral thought. Rowe raises questions about the act of selectively retrieving ideas from a philosophical tradition to support constructive work in another tradition. I argue for the importance of acknowledging how Christian thought has been shaped by what Jeffrey Stout describes as moral bricolage, the selective retrieval of ideas from various traditions, and I contend that this bricolage can continue to be a fruitful means through which Christian ethics engages external traditions. Moreover, the importance of Stoicism's retrieval in early modern philosophy makes the work of eighteenth-century theologians such as Edwards a particularly valuable resource for exploring the plausibility of Christian engagement with the Stoics. C’est à une exploration de cette notion de forme que le Collège de France a consacré en octobre 2011 son colloque multidisciplinaire de rentrée : sa définition en philosophie chez Platon et Aristote, ses applications en mathématiques et en astrophysique, en chimie et en biologie, ses conséquences en psychologie et en linguistique, en anthropologie, en droit et dans les arts. Ces débats ont été aussi l’occasion de se tourner vers des pensées où elle joue un rôle particulièrement important, comme le structuralisme de Claude Lévi-Strauss ou l’histoire de l’art d’André Chastel. Jean-Pierre Changeux est professeur honoraire au Collège de France, chaire de Communications cellulaires. The Association for Computing Machinery's Committee on Professional Ethics has been charged to execute three major projects over the next two years: updating ACM's Code of Ethics and Professional Conduct, revising the enforcement procedures for the Code, and developing new media to promote integrity in the profession. We cannot do this alone, and we are asking SIGCAS members to volunteer and get involved. We will briefly describe the rationale and plan behind these projects and describe opportunities to get involved.

According to David Lewis, the argument from temporary intrinsics is ‘the principal and decisive objection against endurance’. I focus on eternalist endurantism, discussing three different ways the eternalist endurantist can try to avoid treating temporary intrinsics as relational. Two of them, generally known as ‘adverbialism’ and ‘SOFism’, are familiar and controversial. I scrutinize them and argue that Lewis’ scepticism about them is well founded. Then, I sketch a further, to some extent new, version of eternalist endurantism, where the key idea (...) is that intrinsic monadic properties had simpliciter by objects are eternal, time-transcendent properties in Fine’s sense, i.e., properties had by objects regardless of time. Eternal properties of an object are ipso facto sempiternal. When something is P at one time and not P at another, it is radically indeterminate whether it is Psimpliciter or not. I argue that an account along these lines is better placed to treat intrinsic monadic properties of changing objects than any other known alternatives insofar as it recognizes that something is Psimpliciter ; it is able to account for x’s being P at a time in terms of something’s being P simpliciter; it has an answer to the question ‘is \simpliciter?’ when x is P at one time and not P at another. I conclude that endurantism is no less at ease with intrinsics than perdurantism is. (shrink)

A coordinate-free formulation is established for (semi) classical particle-field interactions. The exterior language of spacetime chains and De-Rham currents enables the description to include extended strings and membranes besides point particles. Treating physical fields in terms of sections of particular bundles, a unified account of interactions is presented in terms of an intrinsic action principle on a bundle of jets over spacetime. The theory is illustrated by considering the specific model of point particles with intrinsic spin covariantly coupled to theU(1) (...) andSL(2, C) connections describing the electromagnetic and gravitational fields, respectively. The notion of dual spin is examined in this context and coupled equations for this particle-field system are explicitly derived in a local chart. The current times call for reforms in educational processes. The Covid-19 pandemic had an unforeseen impact on the educational system in all countries. This need for change requires new pedagogies and new methods for teaching and learning. Understanding the need for change is essential for the formulation of adaptive proposals, as well as for the generation of training activities to complement the teaching curriculum. New educational practices lead to a vision of educational quality, with new approaches that allow the continuous (...) integration of knowledge and permanent interaction with the student. This paper presents an analysis of the new teaching methodologies in times of confinement due to the pandemic caused by Covid-19. This is a collection of essays on the work of the German philosopher Friederich Wilhelm Nietzsche. Each essay concentrates on a single work, and the volume is organized on a chronological principle, considering the works in the order in which Nietzsche wrote them. Among the contributors are many Nietzsche scholars, including Ivan Soll, Alexander Nehemas, Frithjof Bergmann, and Arthur Danto. Most of the essays are previously unpublished, and none has been anthologized before.

Cet article commence par examiner trois justifications épistémiques de la démocratie, proposées par José Luis Martí, David Estlund et Hélène Landemore. Tous trois cherchent à montrer en quoi la démocratie possède une tendance à engendrer des décisions correctes, mais font face au risque de légitimer une organisation technocratique du politique, en contradiction avec le principe d’égalité politique. Ils estiment donc que l’argument épistémique ne peut pas suffire à justifier des institutions démocratiques. Cependant, si l’on comprend la valeur «épistémique» d’une décision (...) politique à la fois d’un point de vue factuel et normatif, c’est-à-dire qu’on considère à la fois sa rationalité et son impartialité, une justification épistémique de la démocratie beaucoup plus robuste émerge.
